To direct the Learned PCR Court for under the SC/ST Act(POA), Thoothukudi district to consider the bail application of the petitioners on the same day of surrender in Crime No.462/2022 on the file of the second Respondent police. ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.M.Prabu Advocate for the Petitioners and of Mr.E.Antony Sahaya Prabahar Additional Public Prosecutor for the 1st and 2nd Respondents this Court made the following order:
This petition is filed to grant extension of time to execute the order of this Court dated 23.09.2022 passed in Crl.M.P.(MD)No.11088 of 2022 in Crl.O.P.(MD) No.14925 of 2022.
2.The petitioners filed Crl.O.P.(MD)No.14925 of 2022, seeking for a direction to the PCR Court for exclusive trial under SC/ST Act (POA), Thoothukudi
District, to consider the bail application of the petitioners on the same day of surrender in Crime No.462 of 2022 and the same was allowed by this Court vide order dated 22.08.2022.
3.Since the petitioners could not surrender as directed, the petitioners have filed Crl.M.P.(MD)No.11088 of 2022, seeking extension of time and the same was also considered by this Court vide order dated 23.09.2022 by giving two more weeks. However, the petitioners could not comply with the same. Therefore, after lapse of more than one year, the petitioners filed the present petition with baseless grounds and there is no merit to entertain this petition. Accordingly, this petition is dismissed.
