Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the impugned rejection order in Namuna No. 22/2024 dated 26.09.2024 passed by the second respondent and quash the same as illegal and consequently direct the respondents to grant permission to conduct one day protest fast on 30.09.2024 or any other date convenient to the petitioner's association namely Parugalmalai Vivasaiygal Padhukappu Sangam, Agamalai regarding to eviction notice issued by the Forest Department against the formers of Agamalai Panchayath without causing any disturbance to public.

ORDER

The Writ Petition is directed against the order dated 26.09.2024 passed by the second respondent and for direction to the respondents to grant permission to conduct one day protest fast on 30.09.2024 or any other date convenient to the writ petitioner's association namely Parugalmalai Vivasaiygal Padhukappu Sangam, Agamalai regarding to eviction notice issued by the Forest Department against the formers of Agamalai Panchayath without causing any disturbance to public.

2. Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. It is not in dispute that the writ petitioner's request came to be rejected vide order dated 26.09.2024.

4. When the matter is taken up for hearing today, the learned 2/4

Additional Public Prosecutor appearing for the respondents would submit that the writ petitioner may be directed to give a fresh representation and on such representation, the second respondent will consider the same.

5. Recording the same, the writ petitioner is directed to give a fresh representation incorporating the date before the second respondent and on such representation, the second respondent is directed to consider the same and pass orders within a period of three days from the date of receipt of the representation.

6. With the above direction, the Writ Petition stands disposed of. No costs.
