ORDER : The Court made the following order :- The petitioner/Sole Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 379 of IPC and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.383 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner has illegally transported one unit of river sand in a Bolero Pick Up Van bearing No.TN 49 AE 6179. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case.

4. The learned Government Advocate (Crl. Side) for the respondent police submitted that the petitioner herein is having two previous cases in the same nature.

5. Considering the nature of offence, the overt act attributed against the petitioner and also the fact that two previous cases are pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner herein.
