ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 447, 294(b), 323 and 506(i) of IPC, in Crime No.554 of 2021, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 12.12.2021, there was a wordy quarrel between the petitioner and defacto complainant, due to which, the petitioner abused the defacto complainant in filthy language and attacked him. Therefore, the present case came to be registered.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl.Side) appearing for the respondent would submit that no one has been injured in the incident and there is no previous case pending against the petitioner. 5.Considering the facts and circumstances of the case and also the fact that no one has been injured, this Court is inclined to grant bail to the petitioner, however, with stringent conditions. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.21000 of 2021 6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or his appearance, before the learned Judicial Magistrate No.1, Kuzhidurai, Kanyakumari District, and on his executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned; and the petitioner shall appear before the respondent police daily at 10.30 am and thereafter, as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.

7.The petitioner shall appear before the concerned Magistrate within a period of fifteen days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
