ORDER : The Court made the following order :- The petitioner/accused was arrested and remanded to judicial custody on 26.12.2022 for the offences punishable under Sections 8(c) r/w. 20(b)(ii)(C) and 25 of 1/3

NDPS Act, 1985 in Crime No.1157 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner herein and other accused have illegally found in possession of 15 bags of Ganja weighing about 409 Kgs. Hence, the case.

3. The learned counsel for the petitioner seeks bail on the medical ground.

4. The learned Additional Public Prosecutor appearing for the respondent submitted that the medical certificate produced by the petitioner counsel was verified through Superintendent of Central Prison and the petitioner is in normal condition and hence, he strongly opposed to grant bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering the serious nature of allegations made against the petitioner and that the petitioner's health is in normal condition, this Court is not inclined to grant bail to the petitioner.
