Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondent to issue educational loan application to accept the educational loan application and to disburse the educational loan to a sum of 4000 USD per year (totally 4 years) equivalent to Rs.12,00,000/- for the petitioner's daughter Shanmugapriya to undergo medical course at Ivano-Frankivsk National Medical University, Ukraine. ORDER
This Writ Petition is filed for issuing a Writ of Mandamus directing the respondent to issue educational loan to the petitioner and to disburse the educational loan to the tune of an amount equivalent to Rs.12,00,000/- for the petitioner's daughter Shanmugapriya to undergo medical course at Ivano-Frankivsk National Medical University, Ukraine.
2.Though the petitioner's application was submitted long back, a counter affidavit has been filed on behalf of the respondent stating that the respondent is ready and willing to consider the educational loan if the petitioner approach the bank with sufficient documents. Since the respondent come before this Court saying that the petitioner's loan application if properly submitted would be processed by the respondent, this Court is inclined to dispose of https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD).No.23872 of 2019 this Writ Petition with the following direction: "The respondent bank shall consider the loan application of the petitioner and pass appropriate orders on merits and in accordance with law after hearing the petitioner within a period of four weeks from the date of receipt of the loan application in the manner prescribed by the bank. The said direction is given without expressing any merits regarding the petitioner's eligibility or regarding the norms of the bank." No costs.
