Mr.B.Nambiselvan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.unknown of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 420 of IPC, in Crime No.unknown of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner has not paid amount for the goods he purchased from the defacto complainant and threatened the defacto complainant as if the defacto complainant has committed theft of the petitioner's vehicle. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He has not committed any offence as alleged by the prosecution. He would further submitted that under force during the course of investigation in CSR No.340 of 2023, an amount of Rs.35,000/- was brought from the company of the petitioner through his employee and out of the amount Rs.25,000/- was paid to the complainant and Rs.10,000/- went missing in the police station. Over which, a complaint was also given by the petitioner to the higher authorities.

4. Heard learned Government Advocate (Crl. Side) appearing for the respondent.

5. There shall be a direction to the Superintendent of Police, to conduct enquiry on the basis of the complaint given by this petitioner regarding the above said collection and missing of money and take further action in accordance with law. The petitioner is at liberty to take appropriate action to ventilate his grievances.
