ORDER : The Court made the following order :- The petitioner/A3, who was arrested and remanded to judicial custody on 12.01.2024 for the offences under Sections 8(c) r/w 20(b)(ii)(C) and 25 of NDPS Act in 1/4
Crime No.9 of 2024, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the respondent police intercepted the first accused and recovered 41kgs of Gaja. Based on his confession, the petitioner was implicated in this case.
3.The learned counsel for the petitioner submits that the petitioner is a second year student in the Paramedical Science at Annai College of Paramedical Science, Kumbakonam. He has got absolutely nothing with the case. Just because accidentally he happened to travel in the car, he has been arrayed as an accused. He does not have any previous antecedents. He is languishing in prison from January 2024. 4.Considering the allegations on behalf of the prosecution that the contraband being 40kgs of Ganja has been recovered from A1 to A3 and the petitioner being A3, and considering the fact that the prosecution has produced the material in the form of CDR details to prima facie show that the petitioner cannot plead that he is not in conscious possession and considering the fact that the investigation is completed and the trial is now proceeding, P.W.1 to P.W.4 has already been examined and 12 more witnesses have to be examined, at this stage, I do not see that it is a fit case for the petitioner to be enlarged on bail.
5.Since the petitioner's prayer is rejected, it is for the prosecution to expedite the trial. The prosecution shall produce all the witnesses in the relevant dates, as may be 2/4
fixed by the trial Court. A copy of this order shall also be produced before the trial Court and the trial Court shall make endeavours to complete the trial as expeditiously as possible, in any event, not later than three months from the date of receipt of a copy of this order.
