ORDER : The Court made the following order :- The petitioner/accused, who arrayed as accused was arrested and remanded to judicial custody on 04.06.2023 for the offences punishable under Sections 8(c) r/w. 20(b)(ii)(c) and 25 of NDPS Act in Crime NO. 401 of 2023, on the file of the respondent police seeks bail.

2. The case of the prosecution is that based on the secret information received, the respondent police conducted inspection on 06.10.2023 and at that time the petitioner herein and other accused have illegally found in possession of 21kgs ganja. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his names has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 04.06.2023 and seeks bail.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the contraband recovered from A1 is commercial quantity and the 2/4

petitioner herein also present in the scene of occurrence and hence, he strongly opposed to grant bail to the petitioner.

5. Considering the serious nature of allegations made against the petitioner and also considering the fact that the contraband recovered is commercial quantity, this Court is not inclined to grant bail to the petitioner.
