The petitioner challenges the communication dated 12.04.2024 issued by the second respondent and the order dated 06.05.2024 issued by the fourth respondent.

2. By the said communication and order, the petitioner's application for electricity service connection to his house in S.F.No. 28/5B, situated at Sindhalaipatti Village, Oddanchathiram Taluk, Dindigul District, was rejected.

3. Heard the learned counsel on either side and perused the materials available on record.

4. It is seen that respondents 6 to 8 had raised objections before the authorities, opposing the erection of electricity poles on their patta lands for the purpose of providing service connection to the petitioner. Based on such objections, the petitioner's application came to be rejected.

5. The fifth respondent claims to be a co-owner of the land in S.F.No.28/5B. The petitioner, however, contends that the fifth respondent has given a no objection for the grant of electricity service connection. The petitioner has also produced the Field Map Book, which indicates that S.No.29/1C is classified as a public pathway. According to the petitioner, erection of poles along this pathway would suffice. 3/6

6. The learned counsel appearing for respondents 1 to 4 submitted that electricity service connection can be provided to the petitioner by erecting poles along S.No.29/1C, which is a public pathway. This submission is recorded.

7. In view of the above, the impugned communication dated 12.04.2024 and the order dated 06.05.2024 are not legally sustainable and are liable to be set aside. Accordingly, they are set aside, and the Writ Petition is allowed.

The fourth respondent is directed to provide electricity service connection to the petitioner's house in S.F.No.28/5B, situated at Sindhalaipatti Village, Oddanchathiram Taluk, Dindigul District, by erecting electricity poles along S.No.29/1C, which is a public pathway, without affecting the rights of respondents 6 to 8, who are stated to be in possession of portions of S.Nos.29/1C, 40/2, and 28/2, and subject to the petitioner fulfilling all other eligibility requirements. 4/6

9. The above exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.

10. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
