ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus to direct the 1st respondent to grant No Objection for encashment of the two fixed deposit receipts of Additional intake (Code: APSO 4392) bearing Account No.792294292 and Account No. 792291698 in the Indian Bank, Athiramapattinam Branch ( the 2nd respondent herein) and return the said original two fixed deposit receipts with NOC endorsement for encashment of two fixed deposit amount from the 2nd respondent bank.

2. The petitioner had earlier established a Teacher Training Institute. As a condition for starting the said institution, the petitioner was required to create a fixed deposit, which he duly created in the name of the 1st respondent. 2/6

However, since the Teacher Training Institute is no longer operational and has been closed by the petitioner, he is now seeking to return the amount of the said fixed deposit.

However, the learned counsel for the 1st respondent submitted that the petitioner has not submitted any representation requesting for issuance of the original certificate along with a No Objection Certificate, which is required to claim the fixed deposit from the 2nd respondent. The 1st respondent has not issued the No Objection Certificate or passed any orders in this regard.

4. After hearing the submissions, this Court is of the considered opinion that the 1st respondent has no right to deny the issuance of the No Objection Certificate.

5. Therefore, the 1st respondent is directed to issue the original Fixed Deposit Receipt. In case the Fixed Deposit Receipt is not available, the 1st respondent is directed to issue a No Objection Certificate within a period of four weeks from the date of receipt of a copy of this order. Upon receipt of such No Objection Certificate, the 2nd respondent shall release the fixed deposit amount within a period of two weeks thereafter.

6. With the above observations, this Writ Petition is allowed. There shall be no order as to costs. Cosequently, connected Miscellaneous petition is closed.
