PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 2 and 3 to transfer patta from the name of the petitioner's vendor's vendor by name K. Arasi Olina in respect of house property situate at Samsu Nagar, Ilayankudi Town, Sivagangai 1/6
District, bearing S.No.108/50 by converting the same from manual form to digital form so as to enable the petitioner to access the same as and when necessary, within a time frame as fixed by this Court. The petitioner has approached this Court, seeking a Mandamus, directing the respondents 2 & 3 to transfer the patta from the name of his vendor's vendor, by name, K. Arasi Olina, for the property in S.No.108/50, Samsu Nagar, Ilayankudi Town, Sivagangai District, by considering his application, dated 25.02.2022.
2.The case of the petitioner is that he has purchased a house property to an extent of 987 1⁄2 sq.ft at Samsu Nagar, Ilayankudi Town, Sivagangai District frome one K.A.Jahira Parveen and the said K.A.Jahira Parveen has purchased the subject property 2/6
from one K.Arasi Olina. According to the petitioner, patta for the subject property stands in the name of his vendor's vendor/ K.Arrasi Olina. Therefore, after his purchase, the petitioner has made a request to the respondents for change of patta in his name, based on a sale deed, dated 07.02.2020. However, the same has not been considered by the respondents. Therefore, the petitioner has approached this Court.
3.Mr.B.Saravanan, learned Additional Government Pleader takes notice for the respondents and submits that the petitioner has submitted his application on 25.02.2022 and the same is under consideration of the respondents. According to the learned Additional Government Pleader, there are certain corrections in the FMB Sketch and 'A' Register and to that effect, the Tahsildar, Ilayankudi Taluk has submitted a report to the Revenue Divisional Officer, Sivagangai District and the same would be considered and necessary orders would be passed by the Revenue Divisional Officer, within a reasonable time of eight weeks. 3/6
4.Considering the prayer sought for by the petitioner and recording the submissions made by the learned Additional Government Pleader, without expressing anything on the merits of the claim made by this petitioner on the subject property, this writ petition is disposed of, with a direction to the Revenue Divisional Officer to take a decision on the representation of this petitioner for change of patta, dated 25.02.2022, within a period of ten weeks from the date of receipt of a copy of this order.
