PRAYER :-For Bail in Crime No. 556 of 2021 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/Accused No.4 herein, who was arrested on 24.10.2021 for the alleged offence under Sections 341, 294(b), 302, 506(ii) and 109 IPC in Crime No.556 of 2021, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that due to money dispute between the parties, on the instigation of the petitioner, the other accused persons waylaid the defacto complainant's husband and abused him in filthy language and attacked with aruval, thereby he sustained injury and died. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. Based on the confession statement made by the other accused persons only, this petitioner was implicated in this case.
4.The learned Government Advocate (Crl. side) submitted that investigation is still pending.
5.The accused was arrested on 24.10.2021 and she is in judicial custody for a period of 65 days. Considering the facts and the https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.21067 of 2021 circumstances of this case and the period of incarceration, this Court is inclined to grant bail to the petitioner with certain conditions.
6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Karaikudi and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
