PRAYER :- For Bail in Crime No.317 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners/Accused herein, who were arrested on 01.12.2021 for the alleged offence under Sections 452, 294(b), 324, 307, 506(ii) of IPC and Section 4 of Tamil Nadu Prohibition of Woman Harassment Act, in Crime No.317 of 2021on the file of the respondent police, seek bail.

2.The case of the prosecution is that due to civil dispute between the parties, on 28.11.2021, the petitioners trespassed into the house of the defacto complainant, attacked him and her mother with aruval and iron rod and caused grievous injuries. Hence, the complaint.

3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they were falsely implicated in this case and they have not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl. Side) submitted that there is a civil dispute pending between the parties. Due to which, the petitioners attacked the defacto complainant and his mother, thereby three tooth have been fallen. Injured in this case have been discharged from the hospital. Investigation is still pending. 5.Considering the fact that it is a civil dispute between the parties, injured persons have discharged from the hospital and most https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.21123 of 2021 of the investigation might have been completed, this Court is inclined to grant bail to the petitioners with certain conditions. 6.Accordingly, the petitioners are ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.III, Tirunelveli, and on further condition that the petitioners shall report before the respondent police once in fifteen days at 10.30 a.m. until further orders.
