PRAYER :- For Bail in Crime No.560 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Sole Accused herein, who was arrested on 09.12.2021 for the alleged offence under Sections 379 IPC r/w. Section 21(1) of the Mines and Minerals (Development and Regulation) Act, in Crime No.560 of 2021, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner has attempted to transport 3 units of sand illegally. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl. side) submitted that there is four previous cases against the petitioner in Crime Nos.114 of 2018, 560 of 2021, 34 of 2019 and 19 of 2020, which are similar in nature.

5. Since the petitioner is having four previous cases, this Court is not inclined to grant bail. Accordingly, this criminal original petition is dismissed.
