PRAYER :- For Bail in Crime No. 735 of 2021 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/Sole Accused herein, who was arrested on 29.11.2021 for the alleged offence under Sections 294(B), 341 and 302 IPC, in Crime No.735 of 2021, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that there is a matrimonial dispute between the petitioner and the deceased. The defacto complainant is the mother of the deceased. While the defacto complainant attempted to save the deceased, the petitioner attacked the deceased with a roller stone, he succumbed to injuries. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl. side) submitted that there is no previous case against the petitioner.
5. The petitioner is in custody for only one month. As per the F.I.R, 3 eye witnesses are present at the time of occurrence and seen the occurrence. Since, the offences are grave in nature and incarceration is only one month, this Court is not inclined to grant bail. Accordingly, this criminal original petition is dismissed.
