ORDER

This petition is filed by the accused in Crime No.4 of 2017, for a direction to the respondent Police to conclude the investigation in Crime No.4 of 2017, on the file of the respondent Police, within a stipulated time.

2.This petition is filed by the accused that in view of the case registered against him in Crime No.4 of 2017, he was suspended from service and he was also not allowed to retire from service. This Court is not inclined to entertain this petition. However, today, when the matter is taken up for hearing, the respondent Police filed a status report that the investigation in Crime No.4 of 2017 was initially entrusted to one Sudha, Inspector of Police, Vigilance and Anticorruption, Nagercoil and as she was transferred to Chennai, the investigation was handed over to one John Benjamin, Inspector of Police, Vigilance and Anticorruption, Nagercoil. Since he was also transferred in a short span of time, the investigation was entrusted to the present Investigating Officer on 04.06.2018. 3.According to the present Investigating Officer, she has examined two witnesses and issued summons to 51 beneficiaries and also to the other accused. She has also examined 20 beneficiaries, recorded their statements and collected 10 documents. During the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.16683 of 2019 course of investigation, certain bills were also recovered from the contractor and the same have been sent to the Regional Forensic Science Laboratory, Madurai for comparison of the signatures and only after getting report from the Regional Forensic Science Laboratory, the investigation could be completed. The Investigating Officer has also requested for six months time to complete the investigation, by way of undertaking.

4.In view of the stand taken by the Investigating Officer that the substantial portion of the investigation has been completed and the report of the Regional Forensic Science Laboratory, Madurai is awaited and also in view of the undertaking of the investigating agency that the investigation would be completed within a period of six months, this petition is disposed of.
