Heard Mr.S.Muthumalai Raja, learned Counsel for Revision Petitioner, Mr.A.Thiruvadikumar, learned Additional Public Prosecutor for 1st Respondent and Mr.J.Shankarapandiyan, learned Counsel for 2nd Respondent.
2. This Criminal Revision Case has been filed challenging the order dated 13.08.2019 passed by 1st Additional District and Sessions Judge, Thoothukudi in Crl.A.No.18 of 2016 by confirming the judgment passed by Judicial Magistrate No. 1, Thoothukudi in C.C.No.215 of 2013, dated 18.04.2016.

Mr.S.Muthumalai Raja, learned Counsel for Revision Petitioner would submit that Petitioner was convicted by Judicial Magistrate No.1, Thoothukudi in C.C.No.215 of 2013, dated 18.04.2016 and sentenced to undergo Rigorous Imprisonment for two years and to pay a fine of Rs.2000/- in-default, to undergo three months simple imprisonment for the offence under Section 406 of IPC. 3.1. Aggrieved, Petitioner filed criminal appeal in Crl.A.No.18 of 2016 before 1st Additional District and Sessions Judge, Thoothukudi and the lower Appellate Court, by the judgment dated 13.08.2019 dismissed the appeal and confirmed the judgment passed by Trial Court. 2/6
4. It is submitted by the learned Counsel for both parties that the issues raised between the Petitioner and 2nd Respondent have been resolved. A Joint Compromise Memo has been filed to that effect, wherein it has been stated that the petitioner has agreed to pay Rs.5,00,000/- to the respondent towards full and final settlement in three instalments. The 2nd Respondent has agreed to withdraw the complaint against Petitioner. Learned Counsel, on instructions from 2nd Respondent, also submits that 2nd Respondent has no objection to the Criminal Revision Case being allowed. 5. The learned counsel for the petitioner would submit that the petitioner has already paid a sum of Rs.5,00,000/- to the respondent by way of Demand Draft bearing No.157991 dated 23.02.2026.

In view of the Joint Compromise Memo dated 17.02.2026, orders passed by 1st Additional District and Sessions Judge, Thoothukudi in Crl.A.No.18 of 2016, dated 13.08.2019 and Judicial Magistrate No.I, Thoothukudi in C.C.No.215 of 2013 dated 18.04.2016, are set aside. Consequently, the Petitioner is acquitted.
7. This Criminal Revision Case stands disposed of in terms of the above Joint Compromise Memo dated 17.02.2026, which shall form part and parcel of the order. No costs.
