PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to withdraw the C.C.No.45 of 2019 from the file of the learned Additional District Munsif cum Judicial Magistrate, Vedasandur, Dindigul District and transfer the same to the file of any other competent Court in Madurai District. For Petitioners : Mr.A.Jayaramachandran

ORDER

This petition has been filed to transfer the C.C.No.45 of 2019 from the file of the learned Additional District Munsif cum Judicial Magistrate, Vedasandur, Dindigul District to any other competent Court. .

2.The learned Government Advocate(Crl.side) would submit no such untoward incident took place in the court premises and even according to the petitioners it is only presumption. Therefore he opposed to transfer the case from Additional District Munsif cum Judicial Magistrate, Vedasandur, Dindigul District to any other District Court.

3.Heard Mr.A.Jayaramachandran, learned counsel for the petitioner.

4.Considering the facts and circumstances of the case, the transfer of investigation cannot be considered. Accordingly, this criminal original petition is dismissed. However the trial Court is directed to complete the trail within a period of twelve weeks from the date of receipt of a copy of this order. Consequently, the connected Crl.M.P.(MD).No.9974 of 2019 is closed. 5.Further, the personal appearance of the petitioners 1 to 3 are dispensed with and they shall be represented by a counsel after filing appropriate application. The petitioners 1 to 3 shall be present before the Court at the time of furnishing of copies, https://hcservices.ecourts.gov.in/hcservices/

framing charges, questioning under Section 313 Cr.P.C. and at the time of passing judgment.
