PRAYER :- For Bail in Crime No.792 of 2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Sole Accused, who was arrested on 12.12.2021 for the offences punishable under section 379 of I.P.C., and Section 21
(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No. 792 of 2021, on the file of the respondent police, seeks bail.
2. The case of prosecution is that on 12.12.2021, on receipt of secret information, the Respondent Police had made a surprise raid on the river bed of Kamuthi. At that time, the accused had illegally transported one unit of river sand by using the Tractor bearing Registration No. TN67 BW1769. Hence, this complaint. 3.The learned Counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he seeks bail to the petitioner.

4. The learned Government Advocate (Crl.side) submitted that the petitioner is involved in Crime No.88 of 2019, Crime No.33 of 2020 and Crime No.170 of 2017, which are similar in nature and he indulged in such activities continuously. Hence, he vehemently opposed to grant bail to the petitioner.
5.Considering the facts and circumstances of the case and also considering the fact that the petitioner is having three previous case similar in nature, this Court is not inclined to grant bail to the petitioner.
