For Respondent : Mr.SS.Madhavan, Government Advocate (Criminal) PETITION FOR BAIL Under Section 439 of Cr.P.C. PRAYER :- For Bail in Crime No.606 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioners/A.1 & A.2, who were arrested and remanded to judicial custody on 13.12.2021 for the offences punishable under Sections 8(c), 20(b)(ii)(a) of NDPS Act, 1985 and Section 77 of Juvenile Justice Act, 2015 in Crime No.606 of 2021 on the file of the respondent police, seek bail.

2.The case of the prosecution is that the petitioners were found in illegal possession of 200 grams of ganja. The said contraband was seized by the respondent. Hence, the complaint. 3.The learned counsel for the petitioners would submit that the petitioners are innocent and they have been falsely implicated in this case. He would further submit that the petitioners are in judicial custody from 13.12.2021, hence he seeks bail. 4.The learned Government Advocate (Criminal) appearing for the respondent police would submit that the petitioners are having two previous cases in different nature and the investigation is still pending.

5. Taking into consideration all these facts and also considering the short period of incarceration and also the fact the petitioners are having two previous cases and also the fact that the investigation is still pending, this Court is not inclined to grant bail to the petitioners.
