O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, forbearing the first respondent from altering or changing the patta in respect of the properties situated in S.No.557/1B2, Subdivisions A to K, North Singampunari Group, Singampunari Taluk, Sivagangai District, in violation of his earlier proceedings dated 31.05.2022 in Mu.Mu.A4/2807/2022.

2. The grievance of the petitioner is that he executed a settlement deed dated 17.10.2014 in favour of one of his sons, namely, the third respondent. Since the third respondent attempted to drive the petitioner from his home, the petitioner cancelled the settlement deed dated 17.10.2014 by executing a cancellation deed dated 09.06.2021. The said cancellation deed was challenged by the third respondent before this Court in W.P.(MD) No.12388 of 2021, in which an interim order was passed.

3. Subsequently, the District Registrar cancelled the registration of the cancellation deed dated 09.06.2021, which was challenged by the Page No. 2 of 6

petitioner in W.P.(MD) No.1999 of 2022. This Court, by a common order dated 28.07.2022, allowed the writ petitions holding that the unilateral cancellation of the settlement deed was patently illegal and that the order of the District Registrar cancelling the registration of the cancellation deed dated 09.06.2021 was also without jurisdiction.

Meanwhile, since several suits have been filed with respect to the property in dispute and the same are pending, the first respondent vide proceedings dated 31.05.2022 ordered that the further mutation of revenue records shall be stayed until the disposal of the suits. The said proceedings dated 31.05.2022 are still in force, as there has been no challenge to the same.

5. However, the third respondent is now attempting to change the patta in his name based on the orders of this Court, even though this Court has not granted any liberty to the parties to proceed further, having closed the writ petitions with an observation to conclude the civil suits.

6. Therefore, the petitioner had sent a representation dated 01.08.2023 to the authorities. However, till date, no response has been Page No. 3 of 6

received. Hence, the petitioner was constrained to file the present Writ Petition.

7. The learned Special Government Pleader appearing for the first respondent undertakes to consider the petitioner's representation and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.

8. Recording the aforesaid submissions, without going into the merits of the case, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioner's representation and pass appropriate orders, after hearing the petitioner as well as the private respondents, in the manner known to law within a period of four weeks from the date of receipt of a copy of this order.
