O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus, directing the third respondent to issue patta and survey the land of the petitioner in Survey Nos.583 and 584/2 to an extent of 1 acre 75.5 cents, situated in Pandrimalai Village, Kannivadi, Dindigul West Taluk, Dindigul District, by considering his representation dated 14.06.2024.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents.

3. The learned counsel appearing for the petitioner would submit that a representation has been made on 14.06.2024 for survey and demarcation of the boundaries of the property in question.

4. The learned Special Government Pleader appearing for the respondents submits that, although an appeal suit is pending before the competent civil court, after considering the claims of all parties, proper 2/5

steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

5. In view of the above, this Court directs the third respondent to conduct an inquiry in relation to the petitioner's representation dated 14.06.2024 for survey. Notice shall be issued to the petitioner and the owners of relevant adjacent lands and appropriate orders shall be passed in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act 1923, within a period of eight weeks from today. In the event of any rival claims, the same can be agitated before the competent civil court. No costs.
