ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 406 and 420 IPC, in Crime No.234 of 2023, seek anticipatory bail. 2.The case of the prosecution is that the defacto complainant saw an advertisement in OLX application that a house is available for lease in the petition mentioned address. Therefore, he approached the first petitioner, who introduced himself as the owner of the property and the first petitioner has demanded a sum of Rs.5,00,000/- as lease amount. The defacto complainant has also paid the said amount to the first petitioner and the first petitioner has projected that the petitioner Nos. 2 and 3 would vacate the house after receiving their amount. After some time, the defacto complainant came to know that the petitioners have cheated him and the original owner of the property is one Rajkumar. Hence, the complaint. 3.Heard the learned counsel on either side and perused the material records of the case.

4.Considering the nature of allegation that the petitioners being the members of the family targeted the houses, where the landlords are absentee and posted themselves as the owners or the lessees in OLX application and collected money 2/4

from the prospective tenants, in the guise of leasing out the property for long lease and escaped from the scene and considering the fact that on the similar allegations, several previous cases are pending against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners. 5.Accordingly, this Criminal Original Petition is dismissed. sd/- 04/10/2024 (*) Corrected as per order of the Court dated 16.10.2024 in CRL OP(MD) No.16957 of 2024.
