PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus to direct the respondents 1 to 3 to produce the person or body of the detenu by name Gnana Jyothi, D/o.Murugan, aged about 26 years, before this Court and set her at liberty. This Habeas Corpus Petition has been filed by the mother of the detenu to secure and produce her daughter namely, Gnana Jyothi, who is said to be in the illegal custody of the fourth respondent.
2. Mr.K.Saleem Sait, Special Sub-Inspector of Police, C-5, Karimedu Police Station, was present before this Court, at the time of
hearing. The learned Additional Public Prosecutor, on instructions from the Police Officer, submitted that the third respondent got in touch with the detenu, through mobile No.95662 74587 of the fourth respondent and she has informed the third respondent that she and the fourth respondent are living together at Andaman, as husband and wife. The photos that were sent through whats-app from the above said number was also produced before this Court.
3. In view of the above, nothing much can be done by the third respondent, since the detenu and the fourth respondent are already in Andaman. If the petitioner feels that the detenu is in the illegal custody of the fourth respondent, it will always be left open to the petitioner to work out her remedy in Andaman, by giving a complaint before the concerned Police Station.
4. The third respondent is directed to record the statement of the petitioner and close the complaint.
