O R D E R

This writ petition has been filed for a mandamus seeking for a direction to permit the petitioner to be treated notionally as Forest Range Officer with effect from his initial date of temporary promotion i.e., 02.08.2018 and to grant him all consequential benefits.

2. A counter-affidavit has been filed by the respondent denying the contentions of the petitioner.

3. Admittedly, the petitioner retired from service subsequent to the filing of this writ petition. The petitioner seeks for notional promotion in this writ petition. The law is now well settled by the Hon'ble Supreme Court in the case of Government of West Bengal Vs. Dr.Amal Satpathi and Others reported in 2024 Supreme (SC) 1093, wherein it has been held that a retired employee cannot seek for notional promotion.

4. In view of the well settled law, the prayer sought for in this writ petition cannot be granted. Therefore, this writ petition is not maintainable. 2/4
