PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to issue a direction directing the respondent No.4 to withdraw the case in Crime No.57 of 2018, dated 15.06.2018 registered under Section 174 of Cr.P.C. on the file of Respondent No.5 and entrust the same to respondent No.3 for an investigation of the case by a Competent Officer and file a final report before the Jurisdictional Magistrate within the time stipulated by this Court.

This petition has been filed to transfer the investigation of the case in Crime No.57 of 2018 registered under Section 174 of Cr.P.C., from the file of the 5th respondent to the file of the 3rd respondent.
2.The learned Government Advocate (Crl.side) on instructions would submit that investigation has been completed and the same was closed as "Action Dropped'' by the 5th respondent and also filed the final report before the Revenue Divisional Officer. Therefore, the prayer sought for by the petitioner become infructuous.
3.Recording the submissions made by the learned Government Advocate (Crl.side), this Criminal Original Petition is dismissed as infructuous. However, the fifth respondent is directed to file the final report before the concerned jurisdictional Magistrate after serve the copy of the referred charge sheet to the petitioner. On receipt of the same, the petitioner is at liberty to file a protest petition, before the concerned jurisdictional Magistrate, in the manner known to law. Consequently, connected Miscellaneous Petition is closed.
