ORDER
This Writ Petition has been filed seeking a Writ of Mandamus, to direct the respondents 1 and 2 herein to take action against the third respondent herein for misappropriation of Rs.7,36,000/- from the petitioner's office and further direct the respondents 1 and 2 herein to recover the same and hand over to the petitioner based on his complaint, dated 19.09.2024.
2. When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the State would submit that on the basis of the complaint given by the petitioner, CSR.No.637 of 2021 came to be registered and since the petitioner as well as the third respondent have not turned up, the same was ordered to be closed. Subsequently, the petitioner has given another compliant on 19.09.2024 and the same is pending.
3. Recording the submission made by the learned Additional Public Prosecutor, the scond respondent is directed to issue written summons to the petitioner as well the private respondent for causing their appearance 2/4
before him for enquiry and to conduct enquiry and pass orders within a period of two weeks from the date of receipt of copy of this order.
4. With the above direction, this Writ Petition stands disposed of. No costs.
