ORDER

This Civil Revision Petition has been filed seeking a direction to the learned Additional District Judge, Virudhunagar, to dispose of H.M.C.M.A.No.1 of 2017, within the stipulated time.

2. The learned counsel appearing for the revision petitioner submitted that the revision petitioner herein filed H.M.O.P.No.107 of 2013 before the Sub Court, Aruppukkottai, for divorce. On the other hand, the respondent, who is the wife of the revision petitioner herein, filed H.M.O.P.No.90 of 2013 for restitution of conjugal rights, which was dismissed by order dated 21.10.2016. Aggrieved over the same, the respondent herein filed an appeal in H.M.C.M.A.No.1 of 2017 before the learned Additional District Judge, Virudhunagar. However, the said appeal is pending for the past two years. The learned counsel further submitted that as per the Judicial Notification No.C-5 CAS/2007 Tamil Nadu Case Flow Management in Subordinate Courts/Rules 2007, the matrimonial cases should be disposed of within a period of one year from the date of filing the case. But, the same has not been disposed of till date.

In view of Judicial Notification No.C-5 CAS/2007 Tamil Nadu Case Flow Management in Subordinate Courts/Rules 2007, the learned Additional District Judge, Virudhunagar, to dispose of H.M.C.M.A.No.1 of 2017, on merits and in accordance with law, within a period of four months from the date of receipt of a copy of this order.

5. With the above direction, the Civil Revision Petition is disposed of. No costs.
