ORDER : The Court made the following order :- The petitioner/Accused rank not known, apprehending arrest at the hands of the respondent Police for the alleged offences punishable under Sections Man Missing, 25 (1A), 25(1B)(b) of Arms Act and Sections 120B, 147, 148, 149, 201, 302, 364 and 404 IPC, in Crime No.41 of 2021 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant lodged a 1/3

complaint stating that on 08.01.2023, her husband went to his work. On 10.01.2023 at about 7.40 p.m., he spoke with the defacto complainant stating that he came to Chennai for the purpose of work. Thereafter, his mobile phone was switched off and he went missing. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he is no way connected with the alleged offences. On the basis of confession statement of co-accused, this petitioner has been implicated in this case.

4. The learned Additional Public Prosecutor would submit that totally four previous cases are pending against the petitioner, among which, two cases are registered under Section 302 IPC. Further, the custodial interrogation of the petitioner is very much necessary.

5. Considering the facts and circumstances of this case and also considering the bad antecedents of the petitioner and also that the custodial interrogation is required to complete the investigation, this Court is not inclined to grant anticipatory bail to the petitioner.
