PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents preserve and produce the Call Details Report (CDR) With Tower Location from 01.09.2022 to 30.09.2022 regarding to the mobile numbers 76392 - 83925 and 97879 - 60753 and 90036 - 35299 before the Learned Principal District Court, Karur District in connection with the case in S.C.No. 56 / 2023 and to furnish copy to the petitioner by considering the petitioner representation dated 11.09.2024 in accordance with law For Petitioner : Mr.N.Anantha Padmanabhan for M/s.APN Law Associates For Respondents : Mr.A.Thiruvadikumar Additional Public Prosecutor
ORDER
This Writ Petition has been filed seeking a Writ of Mandamus, to direct the respondents preserve and produce the Call Details Report (CDR) With Tower Location from 01.09.2022 to 30.09.2022 regarding to the mobile numbers 76392 - 83925 and 97879 - 60753 and 90036 - 35299 before the Learned Principal District Court, Karur District in 2/5
connection with the case in S.C.No. 56 of 2023 and to furnish copy to the petitioner by considering the petitioner's representation dated 11.09.2024 in accordance with law
2. In continuation to the earlier order passed by this Court vide order dated 29.11.2024, the learned Additional Public Prosecutor filed a counter confirming that erroneously in the charge sheet there is a mention about CDR report and CCTV footage as a list of documents but those documents are private details of the witnesses and hence not produced before the trial Court. The petitioner made a representation to give CDR details of the persons who are added as witnesses for the period from 01.09.2022 to 30.09.2022. The CDR details is their private information which the prosecution is not relying upon and hence not relied upon document the petitioner cannot claim right of a copy. In confirmation to the same, the petitioner had produced the certified copies of documents which has been filed before the trial Court and from that it is seen that there is no CDR report filed. In view of the same the contention of the petitioner cannot be acceded to. 3/5
3. Recording the same, the Writ Petition stands dismissed. No costs.
