Provident Fund contribution, Gratuity and Surrender Leave to the petitioners together with other monetary benefits by considering their representations submitted by the respective petitioners.

When the matters came up for consideration on 07.04.2026, it was brought to the notice of this Court by Mr. Shaji Bino, learned Special Government Pleader that in an identical circumstances, a Division Bench of this Court held that the writ petition seeking for payment of terminal benefits is not maintainable against the petitioners Society in W.A(MD)No.1885 of 2025 by order dated 28.08.2025. In the light of the same, the matters are listed today for further consideration.
3. Today, the learned counsel for the petitioners contended that the right to life of the petitioners guaranteed under Article 21 of the Constitution of India is affected. This Court is unable to agree with the said contention for the simple reason that the petitioners are having an efficacious alternative remedy under Section 153 of Tamil Nadu Cooperative Societies Act, 1983, before the first respondent, Joint Registrar of the Co-operative Societies for redressal of the grievance which is sought to be agitated in these writ petitions. Following the decision of the Hon'ble Division Bench referred to above, this Court is not inclined to entertain these writ petitions at this stage . 3/6

However, this Court, taking into consideration the fact that the petitioners have already retired from service and they have not received the terminal benefits, deems it appropriate to permit the petitioners to file a revision petition before the first respondent for redressal of their grievance within a period of three weeks from the date of receipt of a copy of this order. In case, if the petitioners choose to file any revisions under Section 153 of the Tamil Nadu Co-operative Societies Act within the time stipulated above, the first respondent,the Joint Registrar shall take up the same on file and pass appropriate orders after conducting necessary enquiry, as expeditiously as possible, at any rate, within a period of eight weeks from the date of filing of the revision petition by the petitions.
