Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus, to call for the records of the 6th respondent auction notice in Na.Ka.No.265/2018 dated 05/09/2018 with regard to 1st item of property (Peria Yeri) and quash the same as it is without jurisdiction and consequently direct the 2nd and 3rd respondents to issue fishing right orders to the petitioner based on the 4th respondents recommendation in Na.Ka.No.999 / E / 2018, dated 01/08/2018.

ORDER

The petitioner has filed the above writ petition challenging the auction notice issued by the 6th respondent with regard to the 1st item of

property and consequently direct the respondents 2 and 3 to issue fishing right to the petitioner.

2. It is brought to the notice of the Court that no auction has taken place with reference to the said Peria Yeri to date. Therefore, the relief claimed has been effectively conceded by not proceeding with the auction. As and when auction is proposed to be held, the petitioner shall also participate and their application be considered.
