O R D E R

Heard Mr.P.Murugesan, learned Counsel for Revision Petitioner and Mr.S.Muthupandi, the Respondent, who appeared in person on his behalf.

2. This Criminal Revision Petition has been filed challenging the order passed by Judicial Magistrate No.I, Sivagangai, in Crl.M.P.No.395 of 2024, in C.C.No.15 of 2011, dated 21.08.2025.

3. Brief facts are that Petitioner married Respondent's sister, Thavamari, in the year 2003. After her marriage, Thavamari, stayed at her matrimonial home for only 15 days. Thereafter started residing at her parental home until her demise on 15.02.2004. A case has been registered in Crime No.124 of 2004 for offence under Section 304-B of IPC against Petitioner and two others on the premise that Thavamari committed suicide because of the Petitioner and the same was taken on file in C.C.No.139 of 2005 before Fast Track Mahalir Court, Sivagangai, which ended up in acquittal on 30.11.2016.

3.1. Whileso, a private complaint was preferred by Respondent, based on which a case was registered and the same was taken on file in C.C.No.15 of 2011 before Judicial Magistrate No.I, Sivagangai and the same is pending. In the circumstances, Petitioner preferred a discharge petition under Section 245 of Cr.P.C in Crl.M.P.No.395 of 2024 in C.C.No.15 of 2011 and the Trial Court dismissed the petition vide order 2/7

dated 03.06.2024. Aggrieved, Petitioner filed the present Criminal Revision Case.

4. This Court vide order dated 22.01.2026 referred the matter to mediation. Pursuant to the mediation, parties have amicably resolved all their disputes. Petitioner and Respondent entered into a settlement agreement dated 25.02.2026 before the Mediation Centre. As per the terms of the said agreement, parties have mutually agreed to resolve their disputes and to close all pending proceedings between them. The terms of settlement agreement dated 25.02.2026 reads as follows: SETTLEMENT AGREEMENT WHEREAS

1. Disputes and differences had arisen between the parties hereto and Crl.RC.(MD) No. 1080/2025 was filed on 30/09/2024 before Madurai Bench of Madras High Court, Madurai.

2. The matter was referred to mediation / conciliation vide an order dated 22.01.2026 passed by The Hon'ble Mr. Justice Mohammed Shaffiq

3. The parties agreed that Mr.V.Maharajan and M.Gnanagurunathan would act as their Mediator/ Conciliator.

4. Several meetings were held during the 3/7

process of Mediation/Conciliation from 04.02.2026 to 25.02.2026 and the parties have with the assistance of the Mediator / Conciliator voluntarily arrived at an amicable solution resolving the above mentioned disputes and differences.

5.The parties hereto confirm and declare that they have voluntarily and of their own free will arrived at this Settlement / Agreement in the presence of the Mediator/ Conciliator.

6. The following settlement has been arrived at between the parties hereto :

1. The Parties shall withdraw the respective cases filed by them against each other mention as under;

A. The 2nd party shall withdraw the private complaint in C.C.No:15/2011 on the file of the Judicial Magistrate No.1 Sivagangai.

B. The 2nd party shall withdraw the Criminal Appeal CR1.A.(MD).No.437/2019 pending before the Hon'ble Madurai Bench of Madras High Court.

C. The 1st party and his relative Suresh son of Govindaraj, Door No: 11/G, Middle Street, Opp. To Chavadi, Madurai, Money suit filed against Ilancheliyan son of Ramalingam at Ramnad District, Paramakudi Taluk, T. Nallur Post, N.Valayanenthal Village, withdraw the suit in 4/7

O.S.No. 710/2016 pending on the file of the IIIAdditional Sub Court, Madurai. The plaintiff in O.S.No: 710/2016 is present in the mediation agreed to withdraw the said suit and he has also signed in the settlement agreement.

D. The 1st party withdraw the Crl.R.C.(MD) No. 1080/2025.

2. The 1a party today 25.02.2026 paid to the 2nd party for a sum of Rs:1,00,000/- (Rupees: One Lakhs Only) as a one time compensation.

Both the parties have executed this settlement of agreement and without any force, coercion, misrepresentation, pressure from any corner and after having been read over to them in their vernacular and after going through and understanding the contents of the same. Both of them will not interfere with peaceful life of each other.

That the parties have no further claim monetary or otherwise and both parties hereby withdraw each and every allegations made by the respective parties against each other in the cases filed in Hon'ble Courts. The parties to this Joint Compromise Memo hereby affirm and declare that one and all the terms shall be strictly and faithfully complied.

7. By signing this Agreement the parties hereto state that they have no further claims or demands 5/7

against each other with respect to Crl.RC.(MD) No. 1080/2025(Case No) and all disputes and differences in this regard have been amicably settled by the parties hereto through the process of Conciliation/Mediation."

5. This Criminal Revision Case is disposed of in terms of the Settlement Agreement dated 25.02.2026. The Settlement Agreement entered into between parties, shall be treated as part and parcel of this order. Consequently, connected Miscellaneous Petition is closed.
