ORDER : The Court made the following order :- The respondent police registered a case as against the petitioners in Crime No.127 of 2025 for the offence under Sections 296(b), 115(2), 118(1), 191(2), 351(3) of BNS @ Sections 103(1), 191(2), 296(b), 351(3) of BNS and remanded them into judicial custody on 23.06.2025. Therefore, the petitioners have filed this petition seeking bail.
2. The petitioners are accused Nos.1 and 4. The case of the prosecution is that the accused, deceased and the defacto complainant are friends and they were consuming liquor on 20.06.2025 at about 11.00 p.m. At that time, there was a wordy quarrel between them, due to which, A2 said to have attacked the deceased with an iron rod. The allegation as against the petitioners is that they have kicked the deceased at the time of occurrence. The deceased was admitted in a hospital and thereafter, he died on 23.06.2025. Hence, this case.
3. The learned counsel for the petitioners submits that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. However, they are languishing in jail from 23.06.2025. He further submits that the co-accused, namely, A3 and A5, have already been granted bail by this Court. Therefore, he prays for grant of bail to the petitioners.
4. The learned Additional Public Prosecutor opposed to grant bail to the petitioners and submits that both the petitioners are having one previous case. 2/4
5. Considering the nature of offence and also considering the period of incarceration and also considering the fact that the co-accused have been granted bail, this Court is inclined to grant bail to the petitioners with certain conditions.

Accordingly, this Criminal Original Petition is ordered and the petitioners are ordered to be released on bail, i) on the petitioners executing a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand)each, with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Thiruchendur.
ii) The petitioners and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the government in proof of their residence address;
iii) The petitioners shall report before the respondent Police daily at 10.30 a.m. until further orders. They have to co-operate for the investigation;
iv) The petitioners shall not misuse the liberty granted to them by indulging in any further offence and shall not tamper with the prosecution witnesses. They shall be available for the trial as well; v) On violation of any of the above conditions by the petitioners, 3/4
the respondent police shall move an application for cancellation of the bail.
