For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PRAYER :- Criminal Original Petition has been filed under Section 439(1)(B) of Cr.P.C. to modify the 2nd condition that the 2nd Petitioner/2nd Accused should appear and sign before the Respondent Police Station daily twice at 10 a.m. and 5 p.m. for a period of 30 days imposed by the Learned Principal District and Sessions Judge,Trichy.

ORDER

This petition has been filed seeking modification of the 2nd condition that the 2nd Petitioner/2nd Accused should appear and sign before the Respondent Police 1/3

Station daily twice at 10 a.m. and 5 p.m. for a period of 30 days imposed by the Learned Principal District and Sessions Judge,Trichy. 2.The learned counsel for the petitioner would submit that the petitioner is a woman and she is residing at Coimbatore District and also having school going children. Her husband is also working in Coimbatore. Hence, she is unable to comply the condition.

3.Therefore, challenging the above said condition, the petitioner is before this Court. Considering the nature of offence only, the above said condition was imposed upon him by the Sessions Court. However, the petitioner without approaching the Sessions Court for modification, directly came to this Court. I find no reason to entertain this petition. This petition deserves to be dismissed.
