PRAYER :- For Bail in Crime No.168 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 05.08.2022 for the offences punishable under Sections 8(c), 20(b)(ii)(c), 25, 29(1) of NDPS Act & Section 25(1) (a) of Arms Act, in crime No.168 of 2022 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner along with others were found in possession of 40 Kg of contraband. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that only based upon the confession of co-accused, this petitioner was implicated in this case. The https://www.mhc.tn.gov.in/judis
petitioner is in judicial custody from 05.08.2022. Hence, he may released on bail for taking treatment.
4.The learned Government Advocate (Crl. side) would submit that totally 6 accused are involved in this case. The petitioner was arrayed as A6. The petitioner along with others were found in possession of 40 Kg of contraband. Since the quantity involved in this case is commercial quantity, he strongly opposed to grant bail to the petitioner.
5.Considering the facts and circumstances of the case and also considering the fact the the contraband involved in this case is commercial quantity, this Court is not inclined to grant bail to the petitioner.
