ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 324, 506(ii) of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 1998, in Crime No.307 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that defacto complainant is the mother and the 1/3

petitioner is the son. A civil dispute exists between the accused and the defacto complainant. Due to the previous enmity, the defacto complainant gave a false complaint alleging that the petitioner has abused her in filthy language, beaten her and criminally intimidated. On that basis the present case was registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He has not committed any offence as alleged by the prosecution.

4. The learned Government Advocate (Crl. Side) for the respondent police submitted that the petitioner is having two previous cases for the offence of assault.

5. Learned counsel for the petitioner would submit that at the time of occurrence as mentioned by the defacto complainant, the petitioner was not available in the place of occurrence.

6. Considering the bad antecedents of the petitioner, this Court is not inclined to grant relief to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
