ORDER : The Court made the following order :- 1/5

The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 324(2), 296(b), 115(2), 118(1) and 351(2) of BNS, 2023 in Crime No.125 of 2025 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the defacto complainant is running a bar attached to a wine shop at Boduvakudi, Paramakudi Taluk, for the past three years. On 22.08.2025, the accused persons came to the bar in two motorcycles at a very high speed. When the defacto complainant questioned them, they abused him in filthy language, assaulted the defacto complainant with beer bottle in his head and thereby causing a bleeding injury. The accused have also attacked the workers in the bar. They have damaged the tables and chairs and criminally intimidated the defacto complainant. Hence the case.

3.The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case. He further submits that the petitioner is working as a painter in Erode. He has come to his native due to the Krishnajeyanthi holidays. He came to place of occurrence only to pacify the parties. 2/5

4.The learned Government Advocate(Crl.side) for the respondent submits that totally there are three accused persons. The petitioner is A2. He would further submit that the defacto complainant is still taking treatment in the hospital as inpatient.

5. The learned counsel for the petitioner submitted that as per the instructions, the defacto complainant has been discharged from the hospital. 6.Considering the facts and circumstances of this case, this Court is inclined to grant anticipatory bail to the petitioner.

7.Accordingly, this criminal original petition is allowed and the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate, Paramakudi, on condition that the petitioner shall execute a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Paramakudi, and on further conditions that:

i. The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the Government in proof of their residence address; ii. The petitioner shall appear before the respondent police daily at 10.30 am for a period of two weeks. He has to co-operate for the investigation.

iii. The petitioner shall not misuse the liberty granted to him by indulging in any further offence and shall not tamper with the prosecution witnesses. The petitioner shall be available for the trial as well.

iv. On violation of any of the above conditions by the petitioner, the respondent police shall move an application for cancellation of the anticipatory bail.
