ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police 1/4

for the alleged offence punishable under Sections 120B, 167, 465, 467, 468, 471 and 409 of IPC and Section 13(1)(a) of Prevention of Corruption Act, 1988 (as amended on 2018) in Crime No.7 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused persons had created false documents and used the same as genuine and misappropriated the Sankarapuram Village Panchayat funds to the tune of Rs.2,56,30,207/- as if the said amount was spent towards labour charges for tree cutting, OHT and syntax tank cleaning, removal of vegetation on both sides of road, gravel spreading, refilling with conveyed earth, road repair works, tractor rent to removal of garbage, removal of waste and cleaning vacant sites. Hence the case. 3.The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. The petitioner is a Block Development Officer, Sakkottai Panchayat Union, Sivagangai District from 09.07.2021 to 18.07.2022. The allegation against the petitioner is Rs.44 Lakhs alone.

4.The learned Government Advocate(Crl.side) for the respondent submits that 2/4

the petitioner along with other accused persons had misappropriated a sum of Rs.2,56,30,207/-. She created false records as if the money was sent towards several works in the panchayat.

5.Considering the facts and circumstances of this case and also considering the quantum of amount involved in this case, this Court is not inclined to grant anticipatory bail to the petitioner.
