PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the 1st respondent to transfer the enquiry of the petitioner's complaint dated 06.09.2023 from the file of the 2nd respondent to some other agencies, within the period stipulated by this Court.

For Petitioner :Mr.A.Haja Mohideen For Respondent :Mr.M.Sakthi Kumar Government Advocate (crl.side) O RDER Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the 1st respondent to transfer the enquiry of the petitioner's complaint dated 06.09.2023 from the file of the 2nd respondent to some other agencies, within the period stipulated by this Court.

2. The learned Government Advocate (Crl. Side) would submit that on the basis of the complaint given by the petitioner, enquiry was undertaken. During the course of enquiry, both sides appeared and they claimed rival title over the property. The petitioner also gave a statement that a suit is pending before this Court. But it is not the suit, it is the Writ Petition in W.P.(MD) No.22383 of 2023 pending on the file of this Court. On the basis of the above said statement, the 2/5

complaint of the petitioner was closed by the respondent Police.

3. In view of the submissions made by the learned Government Advocate (Crl.Side), nothing survives for futher consideration or direction in this matter. Let the closure report be sent to the petitioner, so that he can workout his remedy through appropriate proceedings, if so aggrieved.

4. With the above said direction and liberty, this Criminal Original Petition is disposed of.
