ORDER : The Court made the following order :- The respondent police registered a case as against this petitioner in Crime No.492 of 2025 for the offence under Sections 420, 506(1) of IPC and remanded him into judicial custody on 06.08.2025. Therefore, the petitioner has filed this petition seeking bail.
2.The case of the prosecution is that the petitioner has received a sum of Rs.10,05,000/ from the defacto complainant for arranging the post of VAO Assistant. Hence, the complaint.
3.The learned counsel for the petitioner submits that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. However, she is languishing in jail from 06.08.2025. He further submits that there was a money transaction between the petitioner and the defacto complainant since her husband died. Further, at the time of receiving loan from the defacto complainant, the petitioner was made to sign in some blank documents and using those documents, the defacto complainant has created false record as if the petitioner received money for arranging job. The learned counsel for the petitioner also relied upon the bank statement and G.Pay transaction. According to him, the 2/6
petitioner's husband died in the year 2016 and only thereafter she got appointment on compassionate ground.
4.The learned Government Advocate (Criminal Side) submitted that the petitioner received a sum of Rs.7,00,000/- on 30.06.2022 and Rs.3,05,000/- on 28.03.2023 from the defacto complainant Apart from this, she has also executed an agreement in favour of the defacto complainant that she would arrange a job. Therefore, he oppose for grant of bail to the petitioner.
5. The learned counsel for Intervenor submitted that the petitioner received a sum of Rs.10,05,000/- from the defacto complainant for arranging job. Hence, he opposed for grant of bail to the petitioner.

Perusal of the material shows that the respondent police has conducted the investigation in a mechanical manner without even ascertaining the bank statement of the petitioner for the alleged money transaction between the petitioner and the defacto complainant and the petitioner is also languishing in Jail from 06.08.2025. Considering the manner in which, the investigating agency has conducted the investigation, this Court directs the Commissioner of Police to entrust the 3/6
investigation in Crime No.492 of 2025 to any officer in the rank of Assistant Commissioner of Police for fair and proper investigation. Considering the period of incarceration suffered by the petitioner,this Court is inclined to grant bail to the petitioner with certain conditions.

Accordingly, this Criminal Original Petition is ordered and the petitioner is ordered to be released on bail i) on the petitioner executing a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, ii) The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the government in proof of their residence address;
iii) The petitioner shall report before the respondent police as and when required for interrogation.
iv) The petitioner shall not misuse the liberty granted to him by indulging in any further offence and shall not tamper with the prosecution witnesses. He shall be available for the trial as well. 4/6
v) On violation of any of the above conditions by the petitioner, the respondent police shall move an application for cancellation of the bail.
