ORDER

The Criminal Original Petition has been filed, invoking Section 528 B.N.S.S., seeking orders, to direct the first respondent herein to comply with the order passed by the learned Judicial Magistrate, Theni in Cr.M.P.No.1735 of 2023, dated 04.03.2023 to register the case upon the complaint given by the petitioner, dated 28.12.2022 and 14.01.2023.

It is evident from the records that the learned Judicial Magistrate, Theni, in Cr.M.P.No.1735 of 2023, has passed an order, dated 04.03.2023, directing the Inspector of Police, Theni Police Station, to conduct preliminary enquiry and if any cognizable offence is disclosed to register an FIR and to file the report within a period of one month. 2/4

3. When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the State would submit that in pursuance of the directions of this Court, the Inspector of Police, Theni Police Station, after enquiry, has submitted a report, dated 13.03.2023 and since the learned Magistrate has raised some clarifications, the Inspector of Police has submitted further report on 16.03.2023.

4. Recording the same, this Criminal Original Petition is disposed of. The petitioner is at liberty to file private complaint, if so advised. 14.10.2024 NCC : Yes / No Index : Yes / No Internet : Yes / No das To 1.The Judicial Magistrate, Theni.
