O R D E R

The relief sought for in the present writ petition is to direct the respondents to sanction the pensionary and other benefits to the petitioner by considering the petitioner representation dated 18.09.2019 within a stipulated period.

2. The learned Special Government Pleader brought to the notice of this Court that the petitioner attained the age of superannuation and he was not allowed to retire from service on https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.23838 of 2019 account of the fact that the departmental disciplinary proceedings are pending against him. The petitioner has involved in a corruption case and the criminal case ended with an order of acquittal. The departmental disciplinary proceedings initiated are pending. He further submits that the subsistence allowance is being paid regularly to the petitioner during the pendency of the departmental disciplinary proceedings.

3. This being the factum, only after disposal of the departmental disciplinary proceedings by the Competent Authorities, the petitioner has to submit appropriate representation for the purpose of settlement of terminal and pensionary benefits.

4. With this liberty, this Writ Petition stands disposed of. No costs.
