O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to issue a separate patta in respect of the petitioner's land in S.F.No.156/4A1A1, comprised in Joint Patta No. 305, situated at Sindalakattai Village, Ottapidaram Taluk, Thoothukudi District, by considering the petitioner's application/representation dated 15.09.2023.

The grievance of the petitioner is that he purchased the land comprised in S.F.No.156/4A1A1, measuring an extent of 6 cents, from one Thimmuy Rettiyar on 14.05.2012, in respect of which Joint Patta No. 305 stood in the name of the petitioner's vendor and 34 others. After the purchase of the said land by the petitioner, the petitioner's name was included in the said joint patta. Thereafter, the petitioner approached the first respondent, who directed him to pay the necessary charges and fees for subdivision of the said land.
3. Accordingly, the petitioner filed an application/representation dated 15.09.2023 along with the necessary fee seeking subdivision of the Page No. 2 of 5
land and issuance of a separate patta after surveying the land. However, the same has not been considered by the respondents till date. Therefore, the petitioner was constrained to file the present Writ Petition.
4. The learned Government Advocate appearing for the respondents submits that the petitioner's application/representation will be considered on its own merits and in accordance with law, within a period of twelve weeks.
5. Recording the above submissions and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioner's representation/application dated 15.09.2023 on its own merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The said representation/application shall be considered and disposed of after conducting an enquiry. The first respondent is also directed to afford a reasonable opportunity of hearing during such enquiry to the petitioner, other patta holders, adjacent landowners, if any and any other interested parties who may be affected by the decision. In the event of any rival Page No. 3 of 5
claims, the same may be agitated before the competent civil court. There shall be no order as to costs.
