ORDER

This Writ Petition has been filed seeking to quash the impugned order of the first respondent in Na.Ka.No.3135001/2025/A4 dated 18.07.2025 and the impugned order of the second respondent in Na.Ka.No.5953/2023/A2 dated 28.02.2025, and consequently, to direct the third respondent to issue Patta for a total extent of 4246 sq.ft. (394.4 sq.m.) of land comprised in Old T.S.No.1951/2, New T.S.No.110, Block No.47, Ward No.6, Dindigul East Taluk, Dindigul District.

The case of the petitioner is that her mother, namely Seeniammal, executed a registered settlement deed dated 30.03.1983 in favour of the petitioner in respect of Plot No.3, measuring an extent of 3494 sq.ft. in Old T.S.No.1951/2, New T.S.No.110, Block No.47, out of a total extent of 1 acre and 34 cents, situated in Dindigul East Taluk, Dindigul District.

The grievance of the petitioner is that she has been in enjoyment of an additional extent of 752 sq.ft., over and above the 3494 sq.ft. that was settled in her favour under the above-said settlement deed. According to her, though the settlement deed covers only 3494 sq.ft., the total extent available on ground is 4246 sq.ft., and the entire extent remains in her exclusive possession and enjoyment. The petitioner approached the second respondent by way of an application dated 03.05.2023 seeking issuance of Patta for the additional 752 sq.ft. and for making necessary changes in the revenue records considering her long possession. However, the said request came to be rejected by the first respondent.

4. Heard the learned counsel appearing for the parties.

When it is admitted by the petitioner that the extent settled in her favour under the settlement deed is only 3494 sq.ft., and Patta has already been issued for that extent, the question of this Court directing the respondents to grant Patta for the remaining 752 sq.ft. based solely on her possession does not arise. If the

petitioner has any claim over the additional 752 sq.ft. of land beyond what is covered under the settlement deed, she is at liberty to work out her remedy before the competent Civil Court.

6. With the above observations, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
