RESPONDENT/ACCUSED-A2 Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to cancel the Anticipatory bail granted to the 2nd respondent in Crl O.P (MD) No. 14208/2024 dt. 29.08.2024 on the file of this Hon'ble Court. Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.A.SENTHILKUMAR, Advocate for the petitioner and of Mr.R.M.ANBUNITHI, Additional Public Prosecutor on behalf of the 1st Respondent, the court made the following order:- The petition for cancellation of bail is filed on the ground that the anticipatory 1/3

bail was granted by recording the fact that the petitioner had returned a sum of Rs.3,00,000/- which is erroneous. When the said petition is entertained, learned counsel appearing for the second respondent / accused No.2 had produced further details and statements in support of the same and the learned counsel appearing for the petitioner / defacto complainant disputed further about the same. Therefore, at this stage, it cannot be authoritatively decided that this statement is erroneous or otherwise. In view thereof, when anticipatory bail is granted, no ground to cancel the anticipatory bail is made out at this stage.

2. Accordingly, the prayer to the petitioner to cancel the anticipatory bail cannot be granted by this Court. However, considering the nature of case, the respondent Police is directed to complete the investigation as expeditiously as possible and file a final report before the appropriate forum within a period of two months from the date of receipt of a copy of this order.
