PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus to call for the records connected with the Impugned tender proceedings in No.18, PWD/Buildings (C and M) Circle, Trichy /2025-2026, dated 05.08.2025 on the file of the second respondent and quash the same as illegal and consequently, direct the third respondent to issue petitioner's Site Inspection Certificate in respect of construction of 3 classrooms, 1 boys toilet, 1 girls toilet and a 260m compound wall in Azhagoundanpatti Government School, Trichy District and to issue fresh tender notification with respect to the said work in accordance with law. ORDER
This Writ Petition is taken up for hearing at the time of admission with the consent of the learned counsel for the petitioner and learned Government Advocate for the respondents.
2. The petitioner wants to respond to the Tender Notification, dated 2/5
05.08.2025. It is submitted that despite the best efforts, the third respondent has not issued the Site Inspection Certificate for enabling the petitioner to submit the bid.
3. It is submitted that the last date for submitting the bid expires today and therefore, left with another option, the petitioner is approached this Court for direction to the third respondent to issue a Site Inspection Certificate.
4. The learned Government Advocate for the respondents submits that the Site Inspection Certificate will be issued by tomorrow, i.e., 26.08.2025 and that the petitioner's offer will be received and also the opening of the tender will be postponed by a day, i.e., 27.08.2025.
5. Recording the same, this Writ Petition is disposed of by directing the third respondent to issue the Site Inspection Certificate to the petitioner positively by tomorrow, i.e., 26.08.2025 at 12.00 p.m., to enable the petitioner to upload the offer duly filled with the Site Inspection Certificate. The respondents shall receive the same both electronically and in a physical copy in a sealed cover. 3/5
