2.Writ Petition in W.P(MD)N.23154 of 2023 is filed by R.Annalakshmi with a prayer to call for the records in respect of the document registered as document No.39/2022 dated 23.02.2022 presented
by the 3rd respondent in the said repetition and to quash the same and the same is with reference to induction of one Sasi Rekha. W.P(MD)No.10648 of 2024 is filed by the same Anna Lakshmi, to call for the records in respect of the document registered as document No.26 /2020 in Book-IV dated 18.02.2020 which is presented by the 3rd respondent calling into question the induction of the 4th respondent therein. WP(MD)No.15010 of 2025 is filed by one Santhana Krishnan, again calling for the records with reference to document registered as Document No.249 of 2024, 250 of 2024, 6 of 2025 and 12 of 2025, whereby the questioning the induction of the respondents 4 to 6 by the 3rd respondent therein.
3.I have heard the learned senior counsel and the other learned counsel appearing on behalf of the parties.
4.Upon hearing the learned counsel and perusing the records, it can be seen that the matter relates to the dispute with reference to induction of trustees and registering of documents relating to the trust. It is an inter-se dispute between the petitioners and the private respondents. Absolutely the same cannot be entertained within the jurisdiction under Article 226 of the Constitution of India and it is for the respective petitioners to ventilate their
grievances before the appropriate civil Court. Neither the Sub-Register nor this Court under Article 226 of the Constitution of India go into the validity of the documents which relates to the entitlement of the party who presented the document on that date, and co-operate other persons as the trustees etc which all arises out of the private dispute with reference to the trust deed in question. Therefore, keeping open the liberty of the petitioners as well as the respondents or any persons interested in the trust to approach the competent civil Court, these writ petitions stand disposed of. The issues are left open to be agitated before the civil Court. No costs. Consequently, connected miscellaneous petitions are closed.
