PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the respondents to correct the error of Notification of 'Nilaviyalsalai' in the Column of Note in the petitioner's Patta No.3261 for Survey Nos.18/1, 19/1, 20/1, 21/1A and 23/2A an extent of 2.42 Acres in Vadakkuppanavadali Village, Sankarankovil Taluk, Tenkasi District and restore the original classification of private property by considering his representation dated 05.09.2024 within the period stipulated by this Court. The petitioner seeks for issuance of a Writ of Mandamus seeking disposal of his representation, dated 05.09.2024 to correct the error by removing 'Nilaviyalsalai' in the Column of Note in the petitioner's Patta No.3261 for Survey No.18/1, 19/1, 20/1, 21/1A and 23/2A to an extent of 2.42 Acres in Vadakkuppanavadali Village, Sankarankovil Taluk, Tenkasi District and to restore the original classification as private property. 2.Heard Mr.A.Haja Mohideen, learned Counsel for the petitioner and Mr.S.Kameswaran, learned Government Advocate for the 2/6
respondents.
3.The grievance of the petitioner is that the petitioner's private patta lands, in respect of which patta was also issued in patta No.3261, contains in the column Note, as if the property is classified as 'Nilaviyalsalai'. The petitioner seeks necessary corrections to be carried out. According to the petitioner, it is only a mistake in reflecting the petitioner's private property as 'Nilaviyalsalai'. 4.Mr.S.Kameswaran, learned Government Advocate would submit that the second respondent is the competent authority to address the grievance of the Writ Petitioner.
5.In view of above, the Writ Petition is disposed of directing Writ Petitioner to make a fresh representation to the second respondent enclosing the earlier representation, dated 05.09.2024, as well as the order of this Court within a period of two weeks from the date of receipt of a copy of this order. On receipt of such application from the petitioner enclosing the copy of this order as well as the representation, dated 3/6
05.09.2024, the second respondent shall conduct necessary enquiry and after hearing the parties interested shall pass final orders on merits and in accordance with law within a period of eight weeks thereafter. 6.With the above directions, the Writ Petition is disposed of. No costs.
